Hologic Faces Nearly 200 BioZorb Lawsuits Over Alleged Complications

Hologic, a prominent medical technology company, is currently facing a surge of product liability lawsuits related to its BioZorb breast tissue marker. As of now, at least 183 women have filed claims alleging that the device has caused them to suffer serious side effects, such as device migration, fluid buildup, pain, and scarring. This number is expected to grow as more women who received BioZorb markers experience complications allegedly caused by the tissue marker.

What is the BioZorb Marker?

The BioZorb breast tissue marker is meant to assist in breast cancer treatment by marking the site of tumor removal. It is designed to be a biodegradable device that gradually dissolves in the body while leaving behind titanium clips to indicate the location for future radiographic procedures. However, many patients have reported that the device does not dissolve as expected, leading to various complications.

Allegations Brought Against Hologic

The lawsuits against Hologic allege that the BioZorb device is defective and poses a significant risk of side effects to patients. Common complaints include:

  • Device Migration: Patients have reported that the BioZorb marker moved from its intended position, leading to discomfort and additional medical issues.
  • Pain and Discomfort: Many plaintiffs claim they have suffered from chronic pain and sensitivity in the area where the device was implanted.
  • Fluid Buildup: Some individuals have experienced seromas, which are pockets of fluid that can form around the implant.
  • Scarring: The failure of the device to absorb properly has allegedly resulted in visible scarring and disfigurement.

These allegations have raised serious concerns about the safety and efficacy of the breast tissue marker, leading to nearly 200 BioZorb lawsuits brought by affected patients.

BioZorb Recall and Regulatory Actions

In October 2024, Hologic issued a voluntary recall of the BioZorb and BioZorb LP markers after receiving numerous reports of adverse events. The U.S. Food and Drug Administration (FDA) classified this as a Class 1 recall, indicating that the device could pose a significant risk of serious injury or death if used. Although there have been no reported fatalities, the FDA has advised healthcare providers to monitor patients who have the device implanted and to report any complications.

The FDA’s investigation into the BioZorb tissue marker revealed multiple violations of manufacturing practices by Hologic, including:

  • Inadequate Complaint Review: Hologic allegedly failed to properly address complaints regarding the BioZorb device.
  • Insufficient Design Validation: The company did not adequately test the device to ensure its safety and effectiveness in real-world conditions.

These findings have contributed to the growing scrutiny of Hologic’s practices and the safety of its products.

A Growing Number of BioZorb Tissue Marker Lawsuits

As the number of lawsuits continues to rise, the legal landscape surrounding the BioZorb tissue marker device is becoming increasingly complex. The BioZorb claims are being consolidated in the U.S. District Court for the District of Massachusetts, where Hologic is headquartered. This consolidation allows for coordinated pretrial proceedings, which can streamline the legal process for plaintiffs.

The first bellwether trial, originally scheduled for September 2025, has been postponed to January 2026. Bellwether trials are critical because, while their outcomes have no official bearing on pending lawsuits, they can set a precedent for how similar claims are handled in the future. The result of these trials may influence settlement negotiations and the overall direction of the BioZorb litigation.

Potential BioZorb Injuries and Complications

Patients who have received the BioZorb breast tissue marker have reported a range of alleged complications. Some of the most common potential side effects include:

  • Chronic Pain: Many women have described persistent pain in the area of the implant, which can interfere with daily activities.
  • Infections: There have been reports of infections associated with the device, leading to further medical interventions.
  • Emotional Distress: The physical complications have also resulted in emotional distress for many plaintiffs, as they cope with the implications of their injuries.

Individuals who have suffered injuries allegedly caused by BioZorb markers may be eligible for financial compensation from the manufacturer. BioZorb lawsuits typically seek damages for medical expenses, lost wages, pain and suffering, and other related costs. As the litigation progresses, it is expected that more women will come forward with legal claims.

The Future of the BioZorb Litigation

As the number of BioZorb lawsuits continues to grow, the implications for Hologic and the medical community are significant. The ongoing litigation highlights the importance of patient safety and the need for rigorous testing and oversight of medical devices. The outcome of the upcoming bellwether trials will be closely watched, as they may shape the future of the BioZorb litigation and influence how similar claims are handled in the medical device industry.
