Federal Judge Consolidates Galaxy Gas Nitrous Oxide Lawsuits in Florida Court

A federal judge has transferred a Galaxy Gas nitrous oxide lawsuit from Georgia to Florida, where it will join another similar nitrous oxide claim. “Because Caldwell is broader in scope and encompasses the narrower issues and parties in Iannotti, there is sufficient overlap between first-filed Caldwell and second-filed Iannotti [claims] to apply the first-filed rule,” Judge Cohen stated in his order. “Further, there are no compelling circumstances in this [lawsuit] to avoid application of the rule.”
